These terms govern your use of Kinley, built and operated by Freckle Social Inc. We've kept them readable on purpose. If anything is unclear, email us at katie@joinfreckles.com.

Who we are

Kinley is operated by Freckle Social Inc., a Delaware C corporation headquartered in Oakland, California. Our mailing address is 495 Jackson St #1364, Oakland, CA 94607.

What Kinley is

Kinley is an AI wellbeing companion. She checks in with you, remembers what you tell her, and offers suggestions about everyday wellbeing: sleep, movement, your headspace, and the people in your life. She is powered by artificial intelligence, and she will tell you so if you ask.

What Kinley is not

Kinley is not a doctor, therapist, or licensed professional of any kind, and nothing she says is medical, mental-health, legal, or financial advice. She is a supportive companion, not a substitute for professional care or for the people in your life. If you are in crisis or thinking about harming yourself, contact the Suicide & Crisis Lifeline: call or text 988 (US), anytime. If it's an emergency, call 911.

Who can use Kinley

You must be at least 18 years old to use Kinley. By using the service you confirm that you are 18 or older and able to enter into these terms.

Your account and your info

When you sign up or request a call, you agree to give us accurate information (your real name, a phone number you own, an email you check). You're responsible for activity that happens through your phone number and account. How we handle your information is described in our Privacy Policy; how texting works is described in our SMS Terms.

Calls and messages

When you ask Kinley to call you, you're asking us to place a real phone call to the number you provided, and that conversation is processed by our AI providers and stored so Kinley can remember you. Message and data rates from your carrier may apply. You can ask us to delete your conversations at any time by emailing katie@joinfreckles.com.

Acceptable use

Be a reasonable human. You agree not to:

• Use Kinley for anything unlawful, harmful, or abusive.
• Provide a phone number that isn't yours, or request calls to people who haven't asked for them.
• Attempt to break, overload, reverse-engineer, or extract the models, prompts, or systems behind the service.
• Resell or commercially exploit the service without our written permission.

We may suspend or end access for accounts that violate these terms.

Our content and yours

The Kinley name, character, design, and site are owned by Freckle Social Inc. You keep ownership of what you tell Kinley; you give us the limited rights needed to operate the service (store your messages, process them with our AI providers, and use them to make Kinley work for you), as described in the Privacy Policy.

The service may change

Kinley is in early access. Features may change, break, pause, or be discontinued as we build. We'll do our best to treat your data with care through every change.

Disclaimers

Kinley is provided "as is" and "as available," without warranties of any kind, express or implied. AI makes mistakes: Kinley can be wrong, incomplete, or out of date, and you should use your own judgment (and real professionals) for decisions that matter.

Limitation of liability

To the maximum extent permitted by law, Freckle Social Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, opportunity, or goodwill, arising from your use of Kinley. Our total liability for any claim relating to the service is limited to the greater of $100 or the amount you paid us in the twelve months before the claim.

Ending things

You can stop using Kinley at any time, and you can ask us to delete your account and data by emailing katie@joinfreckles.com. We may suspend or terminate the service or your access to it if these terms are violated or if we discontinue the product.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Alameda County, California.

Changes to these terms

If we make material changes, we'll update the effective date at the top and let you know: by email if we have yours, and by a notice on this page. Continuing to use Kinley after a change means you accept the updated terms.
